German authorities issue regulatory and reporting updates for banks

Deutsche Bundesbank published multiple reporting updates for banks while the Federal Financial Supervisory Authority of Germany (BaFin) published a general decree on the Common Equity Tier 1 (CET1) instruments for cooperative banks, along with the results of a compliance assessment for risk positions secured by residential and commercial real estate under the Capital Requirements Regulation or CRR.

Below is a summary of these recent regulatory developments:

  • Reporting updates from Bundesbank include plausibility checks for reporting under the Securities Holdings Statistics (SHS) regulation, validation rules under the Financial and Risk-bearing Capacity Information Ordinance (FinaRisikoV), and the frequently asked questions (FAQs) on reporting risk-bearing capacity information.
  • An additional recent publication from BaFin is the general decree on Common Equity Tier 1 (CET1) instruments for cooperative banks. The decree regulates the extent to which the newly issued shares in cooperative banks can be classified as CET1 instruments with the regulator permission and helps to determine the conditions under which the repayment of business assets due to canceled cooperative shares is approved in advance. The general decree will be applicable from January 01, 2023 and will remain valid until the end of 2023. The requirements are in line with the Capital Requirements Regulation or CRR and the previous general ruling on CET1 instruments for cooperative banks was limited to December 31, 2022.
  • Furthermore, in its determination of compliance assessment, BaFin notes that, for 2021, the maximum loss rates referred to in Articles 125(3) and 199(3) of CRR (575/2013) for exposures secured by residential immovable property and referred to in Articles 126(3) and 199(4) of CRR for exposure secured by "CRRs" have been complied with. The compliance assessment for risk positions secured by residential and commercial real estate for 2021 will continue to apply until the necessary information for the current and the following year has been evaluated.
